Acceptance of Terms.

Welcome to oefshop.com. The use of the oefshop.com website (the Website) and the sale of products and use of the services and information offered on this Website are governed by the terms and conditions set forth below and all other disclaimers, guidelines, policies, and terms and conditions of sale and/or use appearing on this Website (collectively, the Terms of Use). Your use of this Website in any manner, whether browsing, offering your product reviews, thoughts or ideas, creating a registry or account with us, or making a purchase, constitutes your acknowledgement that you have read the Terms of Use and that you agree to follow and be bound by them. You also acknowledge and agree that any disputes that may arise under these Terms of Use will be governed by the french laws of Paris RCS, without giving effect to any conflict of laws principles.

Changes.

Oefshop reserves the right, at its sole discretion, to modify or replace any of these Terms of Use at any time. It is your responsibility to check the Terms of Use periodically for changes. Your continued use of the Website following the posting of any changes to the Terms of Use constitutes acceptance of those changes. The customer has the ability to save or print these general conditions of sale, but saving or printing this document is the sole responsibility of the customer. The customer confirms that he or she has full legal authority to enter into the purchase agreement under these general conditions.

Information and Subscriptions.

At your election, you may request additional information about oefshop or subscribe to various information services concerning Oef’s products, services and business. When you do so, the registration process requires you to provide your name, and email address. In applicaton of artice L 121-19 of the French consumer's code ("code de la consommation"), the contractual data contemplated by article L 121-18 of the French consumer's code will be the subject of a confirmation, by email no later than the moment of delivery, or else at the address indicated by the customer in the order form.

Privacy.

Oefshop’s use of personal information that you may submit to us through this Website is governed by the oefshop Privacy Policy, which is posted for your review separately on this Website.

Prices

Prices are indicated in Euros and are valid only during the day posted. Prices do not include shipping costs, which are billed in addition and are indicated before the customer validates the order. Prices include the VAT applicable on the day of the order, and any change in the applicable VAT rate will automatically be reflected in the price of products on the on-line boutique. The entirely payment of the price must be paid at the moment of the order.

Delivery problems

Any delivery anomaly (damage, product missing . . .) must necessarily be indicated on the delivery form, accompanied by the customer's signature. The customer should at the same time confirm this anomaly by sending to the transporter and to oefshop, a certified letter (with return receipt requested) within two working days following the delivery date, identifying the problems.

Neither of the two parties will be in default of his or her contractual responsibilities to the extent that their execution is delayed or prevented by a force majeure. A force majeure is defined as a set of irresistible facts or circumstances, external to the parties, that were unforseeable, unavoidable, and independent of the parties' control. The party affected by such circumstances must advise the other of the situation within ten working days following the date on which he or she learned of the situation to cancel the contract. Examples of force majeure include, beyond those often identified by the French courts: transportation blockages, earthquakes, fires, floods, lightning, and telecommunications network difficulties.

Returning products

The customer has seven working days following the delivery of products to return them, whatever the cause may be (non-conformity of the products to the order, exercise of the cancellation right). Any product returned to the company Oef Conception must be returned whole, in its original packaging, and in a perfect condition for resale, to the following address :

Any damaged product will not be reimbursed or exchanged. Except in the event of a delivery error, the shipping charges are the customer's responsibility.

Rules and Conduct.

The Website oefshop.com (including without limitation, any content, documents or other information made available via the Website) is provided only for your personal, non-commercial use. Any unauthorized use of the Website is expressly prohibited.

As a condition of use, you promise not to use the Website oefshop.com for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by oefshop. You agree to abide by all applicable french and international laws and regulations.

By way of example, and not as a limitation, you agree not to upload, post, submit or otherwise distribute or facilitate distribution of any content (including text, communications, images, videos or other information).

Proprietary Rights.

You agree that all content and materials made available by oefshop at the Website are protected by copyrights, trademarks, service marks, INPI, OMPI, patents or other proprietary rights and laws.

Reproducing, copying or distributing any content, materials or design elements on the Website for any other purpose is strictly prohibited without the express prior written permission of oefshop.

International Use.

Oefshop makes no representation that the Content is appropriate or available for use in locations outside France, and accessing the Website is prohibited from territories where such Content is illegal. If you access the Website from other locations, you do so at your own initiative and are responsible for compliance with local laws.

Integration and Severability

These Terms of Use are the entire agreement between you and oefshop with respect use of this Website, and supersede all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and oefshop with respect to this Website.

Miscellaneous.

These Terms of Use contemplated hereunder are personal to you, and are not assignable, transferable or sublicensable by you except with oefshop's prior written consent. Oefshop may assign, transfer or delegate any of its rights and obligations hereunder without consent.
